Matters Involving Children

Parental Responsibility

  • We can advise parents on issues surrounding Parental Responsibility.

  • Parental Responsibility gives parents the authority to make decisions on their child’s behalf.

  • The mother of the child has parental responsibility from birth.

  • The father of the child has parental responsibility if:

    • He is married to the child’s mother.

    • He is listed on the birth certificate and the child was born after 1st December 2003.

In divorce cases where children are involved, the following orders may be made:

  • Child Arrangements Order-This determines where the child or children will live and how much time they can spend with the other parent.

  • Prohibited Steps Order-This is used by one parent to stop the other parent from making certain decisions in relation to their child’s upbringing e.g. removing a child from their school or from the country.

  • Specific Issue Orders-This settles a particular dispute regarding child arrangements after a divorce such as where the child should attend.
