Finances and Property after Divorce
The law relating to the settlement of financial matters between parties following their separation can be highly complex.

The Courts aim to divide the assets fairly between both parties to ensure that each are left in a position of equal standing regardless of their roles as breadwinner and homemaker.

Matters Involving Children
Parental Responsibility
We can advise parents on issues surrounding Parental Responsibility.
Parental Responsibility gives parents the authority to make decisions on their child’s behalf.
The mother of the child has parental responsibility from birth.
The father of the child has parental responsibility if:
He is married to the child’s mother.
He is listed on the birth certificate and the child was born after 1st December 2003.
In divorce cases where children are involved, the following orders may be made:
Child Arrangements Order-This determines where the child or children will live and how much time they can spend with the other parent.
Prohibited Steps Order-This is used by one parent to stop the other parent from making certain decisions in relation to their child’s upbringing e.g. removing a child from their school or from the country.
Specific Issue Orders-This settles a particular dispute regarding child arrangements after a divorce such as where the child should attend.
